Yes! Compensated, gestational surrogacy is legal in Illinois and the state is generally considered a surrogacy-friendly one. The Illinois Gestational Surrogacy Act regulates the process and even ensures that intended parent(s) whose surrogacy contract meets the law do not have to go to court to secure parentage orders. As long as the agreement is valid and forms are filled out as required by Illinois state law, the birth certificate will be completed with the name(s) of the intended parent(s). However, this law only applies when at least one of the intended parent(s) are genetically linked to the child. If both donor egg and sperm are being used, a post-birth adoption will be necessary.
