There is no state law that prohibits surrogacy in Tennessee, so compensated gestational surrogacy is allowed. Instead, the non-genetically related parent will need to go through a stepparent or second-parent adoption to secure their parentage rights. A full adoption after the birth of the child would need to be completed if neither intended parent is related to the child.

Although it’s more complicated for same-sex couples or intended parent(s) using a sperm and/or egg donor, it is possible to complete your family via gestational surrogacy in Tennessee.
